In a significant legal development, U.S. President-elect Donald Trump has urged the Supreme Court to delay the enforcement of a law that mandates ByteDance, the parent company of TikTok, to sell the platform within 270 days or face removal from app stores like Apple and Google. This law, enacted in April by President Joe Biden, cites national security concerns as the basis for its implementation.
According to a legal document filed by John Sauer, Trump’s nominee for Solicitor General, Trump opposes the immediate ban on TikTok and advocates for a negotiated solution to address the government’s concerns while preserving the platform’s operations. The document emphasizes Trump’s willingness to resolve the issue diplomatically after assuming office, highlighting his skills as a negotiator and his intent to find a balanced resolution that safeguards national security without silencing millions of users.
During a recent event hosted by Turning Point USA in Phoenix, Arizona, Trump acknowledged TikTok’s influence, even suggesting that the platform played a role in reaching voters during the presidential election. He expressed openness to keeping TikTok operational in the U.S. for a period, signaling a potential shift in policy if a solution is reached.
The law requiring TikTok’s divestment has faced widespread criticism and legal challenges. In May, TikTok filed a lawsuit against the U.S. government, arguing that the ban infringes on free speech. However, earlier this month, the U.S. Court of Appeals in Washington, D.C. dismissed TikTok’s claim that the ban is unconstitutional.
On December 16, TikTok and ByteDance petitioned the Supreme Court to pause the law, contending that the ban would shutter one of the most popular speech platforms in the U.S. on the eve of a presidential inauguration. The platform is a hub for political discourse, commerce, arts, and other matters of public interest, TikTok argued.
In response, the Supreme Court agreed on December 18 to review the request, setting the stage for a potential reprieve. As debates intensify, Trump’s appeal to delay the ban introduces a new dimension to the controversy, with the potential for a diplomatic resolution under his leadership.
